IOC Creates Guideline For Trans People In Sports

The world of sports is always changing, working to stay ahead of the times and adapt to the new world. Inclusion in sports

On 16/11/2021 the International Olympic Committee (IOC) introduced guidelines that should be the basis for rules of international federations under their role regarding the eligibility of transgender and intersex people. 

From now on, each sport will define its own criteria, which will be valid even for the Olympic Games, but which must follow the principles approved by the IOC Executive Council. One of the most important items in this primer is what the IOC calls “no presumption of advantage”. 

Important Points

Article 5.1 states that: “No athlete shall be prevented from competing or shall be excluded from the competition on the basis of an unverified, alleged or perceived unfair competitive advantage due to their gender variations, physical appearance and/or transgender status.”

Article 5.2 further states that: ” Until evidence determines otherwise, athletes should not be considered to have an unfair or disproportionate competitive advantage because of their sex variations.”

Then, in 6.1 and 6.2, it is stated that any restrictions on the participation of trans people in sport must be based on studies that are “robust” and “peer-reviewed” and that demonstrate “a consistent, unfair and disproportionate competitive advantage in performance” and/or a health risk to other athletes. 

The studies need to be largely based on data collection from a demographic group consistent with the gender and athletic profile of the group that the criterion is intended to regulate.

An Important Decision

In the decision, the IOC also stressed that “it should be within the competence of each sport and its governing body to determine how an athlete may have a disproportionate advantage compared to his or her peers, taking into account the nature of each sport. 

And that is where the document with the guidelines comes from, which also points out that athletes should never be pressured by anyone to take unnecessary medication to become eligible and should not undergo any kind of gynecological examination. Having male or female genitalia makes no difference in deciding someone’s eligibility.
